PARENTING PLAN: LA EXPERIENCIA EN LOS SISTEMAS DE COMMON LAW Y SU RECEPCION EN EUROPA

Abstract

This study analyzes from a comparative perspective the parenting plan as a valuable legal instrument that gives parents the opportunity to design the roadmap for the exercise of parental responsibility after the breakup. The configuration of this legal and socio-educational instrument has a long history in Anglo-Saxon countries (Common Law). But it is somewhat alien to countries located mainlyin continental Europe (Civil Law). However, the incipient reception of the figure clearly shows the rapprochement between the two systems. We also note that, regarding parental responsibilities, the harmonization of European family law is a reality, whose support and common desire is the protection of the interests of the minor, reiterated dagain in Regulation 2019/1111 or Brussels II ter from the point of view of Private International Law.

Este estudio analiza desde un prisma comparatista el parenting plan como instrumento jurídico valioso que brinda a los progenitores la oportunidad de diseñar la hoja de ruta en el ejercicio de la responsabilidad parental tras la ruptura. La configuración de este instrumento de corte legal y socioeducativo tiene un largo recorrido en los países de tradición anglosajona (Common Law). Pero resulta un tanto ajeno a los países situados, principalmente, en la Europa continental (Civil Law). Sin embargo, la incipiente recepción de la figura, muestra, claramente, el acercamiento entre ambos sistemas. Asimismo, damos cuenta de que, respecto a las responsabilidades parentales, la armonización del Derecho de familia europeo es una realidad, cuyo sustento y deseo común es la protección del interés del menor, reiterado nuevamente en el Reglamento 2019/1111 o Bruselas II ter desde la óptica del Derecho Internacional privado.
